These Terms of Service (“Terms”) govern your access to and use of the AmishQuilter website, online store, content, products, and related services (collectively, the “Service”). The Service is operated by Silla Brands LTD, doing business as AmishQuilter (“AmishQuilter,” “we,” “us,” or “our”).
By visiting the Service, creating an account, submitting an order, or purchasing a product, you agree to these Terms and to the policies incorporated into them by reference, including our Privacy Policy, Return and Refund Policy, and Shipping Policy. If you do not agree, do not use the Service.
Certain provisions of these Terms limit our liability and explain how disputes will be handled. Please read the Terms carefully before placing an order.
1. Eligibility and Authority
You must be at least the age of majority in your state, province, or country of residence to make a purchase through the Service. If you use the Service on behalf of a business or other organization, you represent that you have authority to bind that organization to these Terms. You may not use the Service where doing so would violate applicable law.
2. Changes to These Terms
We may update these Terms from time to time. The revised version will be posted on this page with an updated “Last updated” date. Changes apply prospectively unless applicable law requires otherwise. Your continued use of the Service after revised Terms become effective constitutes acceptance of those revised Terms. The version in effect when we accept your order will ordinarily govern that purchase.
3. Shopify and Third-Party Services
Our store is hosted by Shopify Inc., which provides the ecommerce platform that allows us to offer products to you. The Service may also use independent payment processors, shipping carriers, analytics providers, review services, and other third parties. Their services may be governed by their own terms and privacy policies. Nothing in these Terms makes Shopify, a payment processor, or another service provider the seller of products offered by AmishQuilter.
4. Accounts and Customer Information
You agree to provide current, complete, and accurate information when creating an account, placing an order, or contacting us. You are responsible for maintaining the confidentiality of your login credentials and for activity occurring through your account. Notify us promptly if you believe your account or payment information has been used without authorization.
We may suspend or close an account when reasonably necessary to protect the Service, our customers, or our business; investigate suspected fraud or abuse; comply with law; or enforce these Terms. Account closure does not eliminate obligations arising before closure.
5. Product Information
We make reasonable efforts to describe and display products accurately, including their materials, dimensions, construction, condition, colors, and other characteristics. Product descriptions, photographs, availability, and prices may occasionally contain an error. If we discover a material error affecting your order, we may contact you for instructions or cancel the affected item and issue a refund.
Unless a listing clearly states that a photograph is representative, photographs of one-of-a-kind quilts are intended to show the actual item offered for sale. Photographs of products made in multiples may show a representative example. Display settings, lighting, photography, and natural variations in fabric and dye may cause colors to appear different on your screen than they do in person.
Measurements are approximate and may vary slightly depending on how and where an item is measured. Before ordering, review the stated dimensions rather than relying solely on a general size description such as “queen” or “king.”
6. Handmade Products and Natural Variations
Handmade and hand-finished products are not factory-identical. Minor variations in stitching, quilting density, pattern alignment, fabric, dimensions, texture, and color are normal characteristics of handmade work and are not defects by themselves. This provision does not excuse a product that is materially different from its listing or damaged beyond the condition disclosed before purchase.
Descriptions concerning a product’s maker, origin, construction, pattern, materials, or history are based on the information reasonably available to us. When a fact is uncertain, we may describe it as “attributed to,” “believed to be,” “estimated,” or similar language. Such qualified statements are opinions or estimates rather than guarantees of provenance.
7. Vintage, Antique, Previously Owned, and As-Is Products
A product will not be treated as vintage, antique, previously owned, or “as is” unless its listing identifies it that way. These items may show age-appropriate wear, fading, discoloration, repairs, storage marks, fabric weakening, odors, loose stitching, or other signs of age or prior use. We will make reasonable efforts to disclose known material condition issues and to provide photographs when practical.
Dates, ages, makers, patterns, and provenance for older items may be estimates unless the listing expressly states that the information has been documented or guaranteed. An “as is” designation does not waive rights that cannot legally be waived and does not permit us to materially misdescribe an item.
8. Product Care and Use
Follow any care instructions supplied with the product or stated in its listing. Washing, drying, bleaching, exposure to sunlight, storage conditions, pets, smoke, or other environmental factors may cause shrinkage, fading, dye transfer, staining, fiber damage, or deterioration. Unless a listing expressly provides otherwise, we do not guarantee that a vintage, antique, delicate, or handmade quilt is suitable for machine washing or drying.
You are responsible for determining whether a product is suitable for your intended use. Product information is not professional conservation, appraisal, medical, or safety advice.
9. Custom and Commissioned Products
If we offer a custom, personalized, made-to-order, or commissioned product, additional written terms may apply, including terms concerning deposits, measurements, fabric selection, design approval, production estimates, changes, cancellations, and returns. Those product-specific terms are incorporated into these Terms and control if they directly conflict with this section.
Production dates for handmade or custom work are estimates unless we expressly agree in writing to a guaranteed completion date. Custom and personalized products may be nonreturnable except when defective, materially different from the approved specifications, or otherwise returnable under applicable law or the terms provided at purchase.
10. Prices, Taxes, and Payment
Prices are displayed in the currency shown at checkout and may change without notice. A price change will not affect an order we have already accepted, except when the price resulted from an obvious error and applicable law permits correction or cancellation.
You authorize us and our payment processors to charge the payment method you provide for the order total, including product prices, shipping charges, taxes, duties, and other amounts disclosed before you submit the order. Applicable sales tax will be calculated as required by law. Your bank or payment provider may impose separate fees for which we are not responsible.
We do not receive or store complete payment-card numbers when payment is processed by an independent payment provider. Payment processing is subject to the provider’s security procedures and terms.
11. Orders and Acceptance
Your submission of an order is an offer to purchase the products in the order. An automated order confirmation acknowledges that we received the order but does not necessarily mean that we have accepted it. We may accept an order by sending a shipment confirmation, beginning production of a custom product, or otherwise expressly confirming acceptance.
We may decline or cancel an order before shipment for a reasonable business or legal reason, including suspected fraud, payment failure, an incorrect price or description, inventory unavailability, shipping restrictions, duplicate orders, quantity limits, or inability to verify information. If we cancel after collecting payment, we will refund the cancelled amount to the original payment method, subject to the payment provider’s processing time.
Because many quilts are one of a kind and may be offered through more than one sales channel, an item may occasionally become unavailable before inventory records update. In that situation, we will cancel the unavailable item and issue a refund. We are not obligated to substitute a different one-of-a-kind product.
12. Order Limits, Resale, and Fraud Prevention
We may limit quantities purchased per person, household, account, payment method, billing address, shipping address, or order when reasonably necessary. We may review, hold, or cancel orders that appear fraudulent, abusive, unauthorized, intended to circumvent a stated limit, or likely to expose us or another person to loss.
We may request reasonable identity, address, or payment verification before accepting or shipping an order. We will handle verification information in accordance with our Privacy Policy.
13. Shipping and Delivery
Shipping options, charges, and available delivery estimates will be displayed at checkout or described in our Shipping Policy. Processing time is separate from carrier transit time. Unless expressly identified as guaranteed, shipping and delivery dates are estimates.
You are responsible for providing a complete and accurate delivery address. Contact us promptly if a correction is needed. We cannot guarantee that an address can be changed after an order has entered processing or shipment. Additional carrier charges caused by an incorrect address, refusal, or repeated unsuccessful delivery attempt may be deducted from a refund or charged to you to the extent permitted by law and disclosed in our Shipping or Return Policy.
We may ship an order in multiple packages. High-value orders may require a signature or other delivery verification. Carrier tracking information is provided for convenience and may not update in real time.
We will ship within the time stated in the applicable product listing, checkout, or order communication. If we cannot ship within the promised time, we will provide notice and any delay, cancellation, or refund options required by applicable law.
14. International Orders
International orders may be subject to customs review, duties, import taxes, brokerage charges, restrictions, and delays imposed by the destination country or carrier. Unless checkout expressly states otherwise, the recipient is responsible for duties, taxes, and import charges assessed after purchase. We cannot guarantee customs clearance or delivery by a particular date.
We may decline an international order when a product cannot lawfully or reliably be shipped to its destination. You may not purchase or export products through the Service in violation of applicable trade restrictions, sanctions, or export laws.
15. Title and Risk of Loss
Except where applicable law requires otherwise, title to and risk of loss for a product pass to you when the product is delivered to the shipping address provided with your order. A carrier’s delivery scan, signature record, photograph, or comparable delivery record may be used as evidence of delivery. Nothing in this section limits your rights concerning a product that was lost before delivery, delivered to the wrong address through no fault of yours, damaged in transit, defective, or materially nonconforming.
16. Returns, Exchanges, and Refunds
Returns, exchanges, and refunds are governed by our Return and Refund Policy, which is incorporated into these Terms. That policy explains eligibility, applicable time limits, product-condition requirements, exclusions, return authorization, shipping responsibility, and refund processing.
Unless required by law or stated otherwise in the Return and Refund Policy, returned products must be in the condition required by that policy and must not have been used, washed, altered, stained, damaged, or exposed to odors after delivery. Custom, personalized, final-sale, and certain vintage or as-is products may have different return eligibility when clearly disclosed before purchase.
Refunds are issued to the original payment method unless applicable law permits and you agree to another method. Financial institutions and payment providers control how quickly a completed refund appears in your account.
17. Incorrect, Damaged, or Missing Products
Inspect your order promptly after delivery. If a product is missing, incorrect, damaged in transit, defective, or materially different from its listing, contact us as soon as reasonably possible at sales@AmishQuilter.com. Providing the order number and clear photographs of the product, shipping carton, packaging, and carrier label may help us resolve the issue more quickly. Do not discard the product or packaging until we provide instructions.
We may request additional reasonable information or require a return before issuing a replacement or refund. Any requested notice period is intended to help us investigate carrier or fulfillment claims and does not eliminate legal rights that cannot be waived.
18. Promotions, Discount Codes, Gift Cards, and Store Credit
Promotions and discount codes are subject to the terms displayed with the offer. Unless expressly stated otherwise, promotions cannot be combined, are not redeemable for cash, apply only during the stated period, and may exclude designated products, shipping, taxes, gift cards, or prior purchases. We may cancel or correct a promotion affected by fraud, abuse, or a material error, subject to applicable law.
Gift cards and store credit, if offered, may be subject to additional terms disclosed at issuance. Expiration dates, fees, cash-redemption rights, and replacement of lost or stolen value will be governed by those disclosed terms and applicable law.
19. Customer Reviews, Photographs, and Other Submissions
If you submit a review, photograph, comment, suggestion, question, or other content (“User Content”), you retain any ownership rights you have in that User Content. You grant us a nonexclusive, worldwide, royalty-free, transferable, and sublicensable license to host, store, reproduce, edit for formatting or length, publish, display, distribute, and use the User Content in connection with the Service, our products, customer support, and our marketing. This license continues for content already used in published materials, to the extent permitted by law, even if you later remove the original submission.
You represent that you have the rights necessary to submit the User Content and that it is truthful, based on genuine experience when presented as a review, and does not violate another person’s intellectual property, privacy, publicity, or other rights. User Content may not contain unlawful, threatening, deceptive, defamatory, obscene, abusive, discriminatory, or malicious material or harmful code.
We may moderate or remove User Content for a legitimate reason, including a violation of these Terms, but we do not promise to review every submission. We will not condition an incentive on a review expressing a particular positive or negative sentiment. Any material relationship or incentive connected to a review must be clearly disclosed as required by law.
20. Intellectual Property
The Service and its content, including text, product descriptions, photographs, graphics, logos, page design, and software, are owned by or licensed to AmishQuilter and are protected by applicable intellectual property laws. We grant you a limited, revocable, nonexclusive, nontransferable license to access and use the Service for lawful personal shopping and informational purposes.
Without our prior written permission, you may not reproduce, republish, distribute, sell, license, modify, create derivative works from, publicly display, commercially exploit, scrape, or systematically extract the Service or its content, except to the extent such restriction is prohibited by law. No license to use the AmishQuilter name, logos, trademarks, or product photography is granted by these Terms.

21. Prohibited Uses
You may not use the Service:
- for an unlawful, fraudulent, deceptive, or unauthorized purpose;
- to violate intellectual property, privacy, publicity, or other rights;
- to submit false information or impersonate another person;
- to transmit malware or other destructive code;
- to probe, bypass, disable, or interfere with security features;
- to obtain unauthorized access to an account, system, or data;
- to send spam, phishing messages, or abusive communications;
- to collect personal information about others without lawful authority;
- to use automated systems in a manner that materially burdens or disrupts the Service;
- to manipulate prices, inventory, promotions, reviews, or checkout; or
- to assist another person in any prohibited activity.
We may restrict or terminate access for a violation of this section and may cooperate with lawful investigations.
22. Third-Party Links and Content
The Service may contain links to websites, services, or content operated by third parties. We do not control or endorse third-party services merely by linking to them and are not responsible for their content, availability, security, products, or practices. Review the third party’s terms and privacy policy before using its service or completing a transaction with it.
23. Privacy and Electronic Communications
Our collection and use of personal information are described in our Privacy Policy. By using the Service or providing an email address or telephone number, you consent to receive transactional electronic communications concerning your account, orders, payments, shipping, customer-service requests, security, and changes to policies. You are responsible for keeping your contact information current.
Transactional communications are separate from marketing communications. Marketing email or text messages will be sent only as permitted by applicable law and any consent you provide. You may unsubscribe from marketing messages using the instructions included in those messages, but you may still receive nonmarketing communications necessary to complete or service a transaction.
24. Disclaimer of Warranties
Nothing in these Terms excludes or limits an express written warranty, a factual product description that forms part of your purchase, or a consumer right or remedy that cannot lawfully be excluded or limited.
To the fullest extent permitted by applicable law, and except for any express written warranty or product commitment we provide, the Service is provided on an “as is” and “as available” basis. We do not warrant that the website will always be uninterrupted, secure, or error-free, or that every website error will be corrected immediately.
To the fullest extent permitted by applicable law, we disclaim implied warranties concerning the Service and products, including implied warranties of merchantability and fitness for a particular purpose. This disclaimer does not apply where such warranties cannot lawfully be excluded, where a product is materially nonconforming, or where an express written warranty provides otherwise. Some jurisdictions do not permit certain warranty exclusions, so some or all of this section may not apply to you.
25. Limitation of Liability
To the fullest extent permitted by applicable law, AmishQuilter and its owners, officers, employees, affiliates, agents, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, business opportunity, or goodwill, arising from or relating to the Service or a product, even if advised that such damages were possible.
To the fullest extent permitted by applicable law, our aggregate liability arising from a particular order or product will not exceed the amount you paid to us for the product or order giving rise to the claim.
These limitations do not apply to liability that cannot legally be limited or excluded, including liability for our fraud or willful misconduct, death or personal injury caused by conduct for which liability cannot be excluded, or your nonwaivable rights under applicable consumer-protection law. Because some jurisdictions do not allow particular exclusions or limitations, some of this section may not apply to you.
26. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless AmishQuilter and its owners, officers, employees, affiliates, and agents from third-party claims, liabilities, damages, judgments, and reasonable costs arising directly from your unlawful commercial misuse of the Service, your User Content’s infringement of another person’s rights, or your intentional and material violation of these Terms. This section does not require you to indemnify anyone for that party’s own negligence, unlawful conduct, or breach of these Terms.
27. Suspension and Termination
You may stop using the Service at any time. We may suspend or terminate your access if you materially violate these Terms, create a security or legal risk, engage in fraud or abuse, or if we discontinue the Service. Where reasonably practical, we may provide notice before termination.
Termination does not affect completed purchases, accrued payment obligations, or provisions that by their nature should survive, including provisions concerning intellectual property, User Content licenses, warranty disclaimers, liability limitations, dispute resolution, and indemnification.
28. Force Majeure
We will not be liable for delay or failure caused by circumstances beyond our reasonable control, including severe weather, natural disaster, fire, epidemic, labor disruption, transportation interruption, carrier failure, utility or internet outage, cyberattack, governmental action, war, civil unrest, embargo, or supply shortage. This section does not eliminate any cancellation, notice, or refund right that applicable law requires.
29. Governing Law and Disputes
These Terms and any dispute arising from them or the Service are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law principles, except that this choice of law does not deprive you of mandatory consumer protections applicable under the law of your residence.
Before filing a lawsuit, you and AmishQuilter agree to make a good-faith effort to resolve the dispute informally. You may begin that process by sending a written description of the dispute, the relevant order number, and the requested resolution to the contact information below. We will make a reasonable effort to respond within 30 days.
Unless applicable law permits or requires a different forum, any court proceeding shall be brought in a state or federal court with jurisdiction over the county in which AmishQuilter’s principal place of business is located, and each party consents to that court’s personal jurisdiction. Either party may bring an eligible claim in small-claims court. Nothing in this section prevents you from contacting a consumer-protection or other governmental agency or exercising a right that cannot be waived.
30. General Provisions
Entire agreement. These Terms, together with the policies and product-specific terms incorporated by reference, constitute the entire agreement between you and us concerning the Service and your purchases and supersede prior communications concerning the same subject.
Policy conflicts. Product-specific written terms control with respect to the product they cover. The Return and Refund Policy controls the return process; the Shipping Policy controls shipping procedures; and the Privacy Policy controls our handling of personal information. These Terms control on other subjects.
Severability. If a provision of these Terms is held unlawful or unenforceable, it will be enforced to the maximum extent permitted or modified only as much as necessary, and the remaining provisions will remain effective.
No waiver. A failure or delay in enforcing a provision is not a waiver of the right to enforce it later. A waiver must be in writing and applies only to the specific circumstance stated.
Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, corporate reorganization, sale of assets, or transfer of the Service, provided that the assignment does not reduce nonwaivable consumer rights.
No third-party beneficiaries. Except where these Terms expressly state otherwise, they do not create enforceable rights for anyone other than you and AmishQuilter.
Headings. Section headings are provided for convenience and do not change the meaning of these Terms.
